Tort
A tort is a civil wrong for which the remedy is an action in common law. This paper explores categories of tort including negligence, nuisance, trespass, strict and statutory liability.
The writer uses case law to explain considerations in relation to tort such as duty of care, damages and defences. For each category of tort defences are provided, including act of god, volenti non fit injuria, limitation, contributory negligence, prescription and statutory authority and triviality. Reference is made to Rylands v Fletcher 1868, the Water Industry Act 1991, Riot Compensation Act 2016, Animals Act 1971 and Hotel Proprietors Act 1956.
